How Long Does a Divorce Take?
A divorce can take anywhere between 3 and 24 months on average depending on whether it is Uncontested or Contested. I have had some Contested Divorces that have taken well more than 24 months.
In my experience, the average Contested Divorce takes 12-15 months. The amount of time varies according to the level of cooperation between the spouses, the efficiency of the attorneys (or the level of knowledge of the pro se parties), and the availability of the Judge.
Florida Rule of Judicial Administration 2.250 has established 6 months as a reasonable time period for the completion of a Contested Divorce case. This is an aspirational goal for the Judges overseeing divorce cases. The Rule also states: “It is recognized that there are cases that, because of their complexity, present problems that cause reasonable delays.”
The average Uncontested Divorce takes 3 months, which is consistent with the time period stated in Rule 2.250.
