Why Have a Prenuptial Agreement?

​Prenuptial agreements tend to have a negative connotation, or people believe prenuptial agreements are only for other people with wide income disparity and high net worth. However, many of our divorcing clients feel the law is “unfair”, and they may have been able to do something different, and more “fair”, if they had discussed things prior to marriage with a prenuptial agreement.

​When couples first marry, there may be no problems. Over time, the marriage can break down, and the court will not care as much as you do about how your spouse contributed to the breakdown. Divorcing couples accusing one another of doing “bad” things only contributes to the hostility and increases the cost.


Prenuptial agreements assist to lessen the legal issues to be debated, and therefore, potentially lessen the overall cost of a divorce, which in America costs on average $15,000.

If your spouse over time lessens their employment marketability, or even intentionally runs up debt that you don’t know about, you could be stuck paying the price in a divorce.

The Florida courts are required to inventory all of your assets and liabilities and divide them fairly, which usually means equally. The court can even give the lower wage earning spouse alimony. These decisions can be decided or limited beforehand with the use of a prenuptial agreement.
