Arbitration
Arbitration is a process where the disputing parties choose a person to decide how to resolve their dispute. It is designed as a less complicated, less expensive and faster process for resolving disputes. As opposed to mediation, arbitration results in a decision of the dispute. Similar to a Judge, an arbitrator can consider evidence presented by the parties and then make a decision. The rules and procedures are more relaxed and less formal in arbitration compared to a courtroom proceeding.
In Divorce and Family Law matters, Florida law does not allow an arbitrator to make any decisions concerning children, parenting, and child support. However, an arbitrator may offer a decision that will assist you in your negotiations. The Arbitrator's decision can address children, parenting, child support, division of property, and alimony.
