Why You Should Use the Collaborative Process to Create Your Prenup

Prenuptial agreements are awkward and uncomfortable, but they involve important conversations you should have before getting married. They set out a framework to help both of you clearly articulate your expectations during the marriage.  If you were to divorce, rather than be stuck with a "one size fits all" approach under Florida law, you can create your own agreement based on your unique values and priorities. Prenuptial agreements have an estate planning function as well.

As you embark upon your life together and have these difficult conversations, a prenuptial agreement should generate marital harmony, not feelings of negativity or conflict. A prenup should be an opportunity to discuss your expectations and shape your future together. Unfortunately, the negotiation of a prenuptial agreement can become adversarial because of how the process is structured.

The Collaborative process is the best way to negotiate your prenup in a more harmonious and cooperative way. It allows you to address all legal, financial, and emotional aspects with the assistance of a professional team that includes your lawyers, a communications professional (who can safely guide difficult conversations toward better understanding) and a neutral financial professional (who helps create financial solutions for the benefit of both of you over time).

The Collaborative process allows you to communicate your feelings about the prenup in a safe, comfortable, and focused environment.
